Agreement to Terms

By accessing or using FactorIQ ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

Description of Service

FactorIQ is a portfolio risk analysis tool that provides stress testing, factor analysis, Monte Carlo simulations, and related analytics for educational and informational purposes. The Service allows users to upload portfolio data and receive risk metrics and visualizations.

The Service does not constitute a recommendation, solicitation, or offer to buy or sell any securities or financial instruments.

No Fiduciary Relationship

Your use of FactorIQ does not create an investment advisor-client relationship, fiduciary relationship, or any other professional relationship between you and FactorIQ. We do not know your personal financial situation, investment objectives, or risk tolerance, and cannot provide personalized advice.

Regulatory Status

FactorIQ is not a registered investment advisor, broker-dealer, financial planner, or financial institution under the Investment Advisers Act of 1940, the Securities Exchange Act of 1934, or any state securities laws. We are not licensed to provide investment advice in any jurisdiction.

Model Limitations

Our calculations use simplified models based on historical data, sector-level approximations, and statistical assumptions that may not accurately reflect your actual portfolio's behavior. The stress test scenarios are hypothetical illustrations based on historical events and may not predict how your portfolio would actually perform in similar future events.

Investment Risks

  • Past performance does not guarantee future results. Historical data and backtests cannot predict actual future performance.
  • All investments involve risk of loss. You could lose some or all of your invested capital.
  • Markets are unpredictable. Future market events may be more severe or different than historical scenarios.
  • Individual securities may behave differently. Sector-level approximations may not reflect specific stock behavior.
  • Data may contain errors. We do not guarantee the accuracy, completeness, or timeliness of any data or calculations.

Your Responsibilities

  • Do your own research. Verify all information independently before making any investment decisions.
  • Consult professionals. Seek advice from qualified, licensed financial advisors, tax professionals, and legal counsel.
  • Understand your risk tolerance. Only invest money you can afford to lose.
  • You are solely responsible. Any investment decisions you make are your own responsibility.

User Accounts

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access
  • Accept responsibility for all activities under your account

Subscriptions and Payments

Free Tier

The free tier provides limited access to portfolio analysis features as described on our pricing page. Free accounts may be subject to usage limitations.

Pro Subscription

Pro subscriptions are billed monthly or annually in advance. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Founder Pricing

Users who subscribe during our launch period receive "founder pricing" which remains locked at the discounted rate for the lifetime of their continuous subscription. If you cancel and later resubscribe, standard pricing will apply.

Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation, you will retain access to Pro features until the end of your current billing period.

Refunds

Refunds are provided at our discretion. If you have questions about your subscription, please contact us.

Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Scrape, crawl, or use automated means to access the Service without permission
  • Redistribute, resell, or commercially exploit the Service without authorization
  • Upload malicious content or data

Intellectual Property

The Service, including its design, features, content, and underlying technology, is owned by FactorIQ and protected by intellectual property laws. You retain ownership of your portfolio data, but grant us a limited license to process it for providing the Service.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACTORIQ AND ITS OPERATORS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:

  • Any investment losses, trading losses, or financial losses of any kind
  • Any decisions made based on information provided by the Service
  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Any errors, inaccuracies, or omissions in the data or calculations
  • Any interruption, delay, or failure of the Service
  • Any third-party actions or content

DISCLAIMER OF WARRANTIES. The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, reliability, or non-infringement.

NO GUARANTEE OF ACCURACY. We do not warrant that the calculations, projections, or analyses provided by the Service are accurate, complete, reliable, current, or error-free. You acknowledge that any reliance on such information is at your own risk.

MAXIMUM LIABILITY. In no event shall our total liability exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

User Acknowledgments

By using the Service, you expressly acknowledge and agree that:

  • You have read and understood the disclaimers in these Terms
  • You understand that FactorIQ does not provide investment advice
  • You are solely responsible for your own investment decisions
  • You will not rely solely on FactorIQ for making investment decisions
  • You will consult with qualified professionals before making financial decisions
  • You understand that all investments involve risk of loss
  • You will conduct your own independent research and due diligence
  • You are of legal age to enter into this agreement in your jurisdiction
  • You are not relying on any representation not expressly stated in these Terms

Indemnification

You agree to indemnify, defend, and hold harmless FactorIQ and its operators, affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any investment decisions you make based on or related to information provided by the Service.

Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of significant changes when possible. Continued use of the Service after changes constitutes acceptance of the modifications.

Termination

We may terminate or suspend your account at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

Governing Law

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the new terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new terms.
